Hypersourced (“us,” “we,” or “our”) operates the www.hypersourced.com website (the “Service”). This Privacy Policy governs the collection, use, and disclosure of Personal Information we collect from our customers and online users (“you” or “your”) and other information automatically collected from your online visits (collectively, “Information”) when you use our Service. We will not use or share your Information with anyone except as described in this Privacy Policy. We use your Information to provide and improve the Service. By using the Service, you agree to the collection and use of your Information in accordance with this Privacy Policy.

We are committed to protecting your privacy and ensuring compliance with applicable laws, including the Telephone Consumer Protection Act (TCPA), guidelines from the Cellular Telecommunications Industry Association (CTIA), and requirements from The Campaign Registry (TCR). TCR is an organization created to regulate and improve the delivery of commercial text messages, including SMS messages, in the United States.

Collection and Use of Personal Information
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. This information may include, but is not limited to, your email address, name, company name, and phone number (including mobile numbers for SMS communications) (“Personal Information”).

We collect Personal Information to provide the Service, identify and communicate with you, respond to your requests/inquiries, service your purchase orders, and improve our services. Specifically:

- Phone Numbers and SMS Use: We collect phone numbers voluntarily provided during phone consultations or interactions to enable communications about job opportunities. SMS messaging is used only with your explicit consent, obtained in writing by replying to our "SMS Consent email". Consent is voluntary and can be withdrawn at any time (see Opt-Out section below).

We do not collect sensitive information without consent and limit collection to what's necessary for our fixed-fee per-hire recruitment services (e.g., sourcing candidates via LinkedIn, no job boards).

Logging Data
We collect information that your browser sends whenever you visit our Service (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Service, the time and date of your visit, the time spent on those pages, and other statistics.

Additionally, we may use third-party services such as Google Analytics to collect, monitor, and analyze this type of information to improve our Service’s functionality. These third-party service providers have their own privacy policies addressing how they use such information.

Cookies
Cookies are files with a small amount of data, which may include an anonymous unique identifier. They are sent to your browser from a website and transferred to your device. We use cookies to collect information to improve our Services for you.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. Most browsers' “Help” feature provides information on how to accept cookies, disable cookies, or notify you when a new cookie is received.

We may employ third-party companies and individuals to facilitate our Service, provide the Service on our behalf, perform Service-related services, and/or assist us in analyzing how our Service is used.

These third parties have access to your Personal Information only to perform specific tasks on our behalf. They are obligated not to disclose or use your Personal Information for any other purpose. Examples include:

- SMS and Communication Providers: Such as providers for SMS delivery and TCR for campaign registration and verification. We share phone numbers and consent records solely to enable compliant messaging and improve deliverability. No data is sold.

Communications
We may use your Personal Information to contact you with job opportunities that may be of interest to you. You may opt out of receiving any or all of these communications by following the unsubscribe link or instructions in any email we send.

SMS-Specific Communications and Opt-Out: You may consent to receive SMS by replying to our "SMS consent email" which will be sent to you by a Hypersourced employee. Message & Data rates will apply. Message frequency may vary. SMS messages will be conversational and strictly about job opportunities using our registered 10DLC numbers. To opt out:

- Reply "STOP" to any SMS (processed within 10 minutes; standard carrier rates apply).
- Text "HELP" for assistance.
- Contact us via email or phone to revoke consent.

SMS opt-in consent or phone numbers for SMS purposes will NOT be shared with third parties and affiliates for marketing purposes.

We retain your phone number for 30 days post-opt-out to honor the request and prevent accidental re-sending. Consent is not required to use our core services (e.g., candidate sourcing, fixed-fee hiring at $20K first hire, $17.5K second, $15K+ beyond). For double opt-in, we may send a confirmation SMS upon verbal agreement.

Legal Compliance
We will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Service. This includes sharing with regulatory bodies like TCR or CTIA for SMS compliance audits.

Business Transaction
If we are involved in a merger, acquisition, or asset sale, your Personal Information may be transferred as a business asset. In such cases, we will provide notice before your Personal Information is transferred and/or becomes subject to a different Privacy Policy.

Security
The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices to protect it from unauthorized access, destruction, use, modification, or disclosure (e.g., encryption for SMS data in transit).

However, please be aware that no method of transmission over the Internet or method of electronic storage is 100% secure, and we are unable to guarantee the absolute security of the Personal Information we have collected from you. We retain Personal Information only as needed for services (e.g., 2 years post-interaction) or legal requirements, then securely delete it.

Links to Other Websites
Our Service may contain links to other sites not operated by us. If you click on a third-party link, you will be directed to that third-party’s site. We strongly advise you to review every site's privacy policy.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Children’s Privacy
Only persons age 18 or older have permission to access our Service. Our Service does not address anyone under the age of 13. If you are under 13 years of age, please do not submit any Information through our Service without a parent or guardian's express consent and participation. We do not knowingly collect Personal Information from children under 13. If you are a parent or guardian and you learn that your child under 13 has provided us with Personal Information, be sure to get in touch with us immediately. If we become aware that we have collected Personal Information from a child under age 13 without verification of parental consent, we take steps to remove that Personal Information from our servers. Minors under 13 cannot consent to SMS without parental approval.

Changes to Privacy Policy
We will update or make changes to our Privacy Policy periodically, and you should check this Privacy Policy periodically. If we make changes to this Privacy Policy or make any material changes to how we use your Personal Information, we will revise this Privacy Policy to reflect such changes and revise this Privacy Policy’s Effective Date located below. Your continued use of the Service after we post any modifications to this Privacy Policy will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
